Article 1 – Definitions

3Leer B.V.

The private limited company 3Leer B.V., located at Achterste Kamp 15, 3751 JH Bunschoten-Spakenburg, registered with the Dutch Chamber of Commerce under number 91850479.

User

Any individual or legal entity using the Pragma app, including students, parents/guardians, teachers, and educational institutions.

App

The mobile and/or web application “Pragma,” developed by 3Leer B.V.

Service

All functionalities of the app, including licenses, exam training, learning paths, dashboards, and teacher communication.

Article 2 – Scope

• These terms apply to all use of the app and to all agreements made via the app or relating to the services of 3Leer B.V.
• By using the app, the user agrees to these terms and conditions.

Article 3 – Use of the App

• Students receive an account outside of the app.
• Students can select their educational level after login.
• The app displays available subjects and grants access based on purchased licenses.
• Teachers have access to a secure dashboard showing the progress of students in their class.

Article 4 – Intellectual Property

• All rights to the app, content, methodologies, and software are owned by 3Leer B.V. or its licensors.
• It is not permitted to copy, modify, trade, or publicly distribute any part of the app without prior written consent.

Article 5 – Liability

• 3Leer B.V. is not liable for damages arising from the use of the app, except in cases of intent or gross negligence.
• No guarantees are made regarding exam results or learning outcomes. The app serves as a supplementary educational tool.
• Interruptions or temporary unavailability of the app do not entitle the user to compensation.

Article 6 – Data Protection

• 3Leer B.V. processes personal data in accordance with its current privacy policy.
• Student data is shared only with authorized teachers and never with third parties without consent.
• 3Leer B.V. does not use advertising or share user data for marketing purposes.

Article 7 – License and Payment

• A valid license is required to access learning content. Licenses are personal and non-transferable.
• Payment is made via the app’s available payment methods or through school licenses.
• Refunds are not available after purchase, unless legally required.

Article 8 – Termination of Use

• Users may delete or cancel their account at any time.
• In cases of misuse or violation of these terms, 3Leer B.V. may suspend or permanently block the account.

Article 9 – Amendments

• 3Leer B.V. reserves the right to amend these terms.
• Significant changes will be communicated in advance via the app or by email.

Article 10 – Governing Law

These terms are governed exclusively by Dutch law. Any disputes will be submitted to the competent court in Midden-Nederland.

2. What data do we collect?

• Account information: name, email address, educational level, selected subjects.
• Progress data: initial test scores, learning paths, achieved results.
• Device data: operating system, device type (for technical support only).
• Teacher-provided data: class groupings, feedback, progress overviews.

Note: We do not collect health data, location data, phone data, or other sensitive information unrelated to educational purposes.

3. How do we use this data?

• Provide personalized learning paths for students.
• Display progress reports to authorized teachers.
• Perform technical maintenance, troubleshooting, and app optimization.
• Fulfill legal obligations (e.g., financial documentation).

4. Data Sharing

• With teachers: only the student’s progress data, strictly for relevant subjects.
• With external processors: such as hosting or payment services, bound by contract and privacy obligations.
• By legal obligation: if required by a competent authority.

We do not sell data and we do not show ads in the app.

5. External Services (SDKs and Tools)

We use external services for technical functions (e.g., hosting, email, authentication, analytics, payments). These parties are not named individually, but all comply with the GDPR and are contractually bound to protect your data.

These services may not use your data for their own purposes.

6. Data Security

• Data is transmitted via encryption (HTTPS).
• Accounts are secured with a username and password.
• Only authorized staff have access to sensitive data.

7. Data Retention

• Student data is retained for up to 1 year after the license ends, unless the user requests deletion earlier.
• Teacher and class data are deleted when the school relationship ends.
• Technical logs are kept for a maximum of 90 days for troubleshooting purposes.

8. User Rights

• Right to access, correct, or delete personal data.
• Right to object to data processing.
• Right to data portability (e.g., export).
• Right to withdraw consent (where applicable).

9. Deleting Your Account

Users can delete their account at any time via the app or by contacting us at info@3leer.nl.
When an account is deleted, all associated personal data is also deleted, unless legal retention requirements apply.

10. International Data Processing

All data is stored within the European Economic Area (EEA). No data is transferred outside the EEA without appropriate safeguards.

11. Children and Students

Our app is intended for use by secondary school students. We process only the data necessary for educational purposes, in cooperation with parents and/or schools.

We do not create advertising profiles and do not repurpose data for commercial use.

12. Changes to This Policy

We may update this privacy policy. Major changes will be announced in advance via the app or email. The latest version is always available on our website.
